I remember coming across a news article on social media where an image had been replaced with an AI-generated one. Since I work with AI – I recognized it as an AI generated graphic right away. What’s surprising is that no one seemed to notice or comment on it in the article’s comment section.

One notable example of AI-generated art is the portrait of Edmond de Belamy, created by the Paris-based art collective Obvious using a generative adversarial network (GAN). The artwork sold for a staggering $432,500 at Christie’s auction house in 2018, signaling a new era for AI-generated art in the mainstream art world. As AI technology continues to advance, we can expect to see even more awe-inspiring and thought-provoking art and graphics popping up in our social media feeds and news outlets.

 Can You Sell AI-Generated Art? 

Alright, let’s talk business. The burning question on everyone’s mind is, can you actually sell AI-generated art and make some cold hard cash? 

Well, the short answer is yes, you absolutely can! 

In fact, there are already plenty of artists and designers out there who are using AI algorithms to create stunning and unique pieces of art, from abstract paintings to intricate digital designs. 

As an example, I create and sell these mockups for digital products. The image was created using MidJourney and then the frames were added using Canva. I often get the doubtful comments of…”ya, but do they sell?”

Can I Legally Sell AI Art?

To answer this question, it’s best to check the terms of use of the AI program you are using. Since MidJourney is a very popular AI art creator, we will refer to their terms of use.

MidJourney states that you own your images in which case you can do what you wish with them.

“Subject to the above license, You own all Assets You create with the Services, to the extent possible under current law. This excludes upscaling the images of others, which images remain owned by the original Asset creators. “

*except if you have a free plan, in which case you DO NOT own the images.

It also notes that  you can use upscaling and remixes of others’ creations.

This all means you can create to use for your personal use or commercial use (provided you don’t require a pro plan based on your companies revenue).

In terms of copyright, MidJourney claims the copyright to the images created using the program.  

“By using the Services, You grant to Midjourney, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable no-charge, royalty-free, irrevocable copyright license to reproduce, prepare Derivative Works of, publicly display, publicly perform, sublicense, and distribute text, and image prompts You input into the Services, or Assets produced by the service at Your direction. This license survives termination of this Agreement by any party, for any reason.”

This isn’t too concerning because current law doesn’t allow copyrights to AI generated images because they “are not the product of human authorship” https://www.copyright.gov

One platform that’s been making waves recently is Dall-E, a South Korean AI art generator that’s been creating some seriously impressive pieces. But, if I’m being honest, I’m a bit biased towards MidJourney, which I think is one of the best options out there right now. The only down-side is that it can only be accessed through Discord, which may not be the most user-friendly option for some people. But the gorgeous images it creates make it worth looking past this!
